盲人在家揮仗打傷人　屬自衛判無罪

盲人吳姓男子被丁姓鄰居指控常在凌晨製造噪音擾鄰，去年9月找里長陪同到吳家察看，吳開門後丁立刻衝進屋內，雙方爆發衝突，吳告丁侵入住宅、傷害，丁也指控被吳持柺杖打傷。

吳否認打人，指稱：「是相信里長才開門，但丁未經同意進屋，我氣他欺負盲人才持柺杖敲地叫他出去，但沒打到他，反而是他抓傷我的手。」

台北地院認為，男揮動柺杖難免會打到人，但家是安全、放鬆的最後堡壘，對盲人更是如此，吳認為丁「侵門踏戶」才揮動柺杖排除，屬「誤想正當防衛」，沒有傷害故意，且吳處弱勢，在無計可施情況下才揮打柺杖，因此判吳無罪。丁男被指侵入住宅，檢方日前認定丁男進入吳家是為察看噪音來源，有正當理由不起訴他。
