丟還白包不構成侮辱　姐告妹不成

【潘岳／宜蘭報導】宜蘭一名53歲黃姓婦人，1年多前與兄姐多人在宜蘭地院調解分割遺產糾紛時，將一只包有2萬元白包丟給有怨隙的大姊，事後被大姊指控涉嫌公然侮辱；宜蘭地院審理後採信黃婦說詞是要返還奠儀，並無貶損之意，丟還白包舉動雖令人不悅，但難認與公然侮辱罪之要件相符，今天對黃婦做出不起訴處分。

黃婦庭訊時供稱，丈夫去世時，大姊包了1萬1千元奠儀，後來大姊與她交惡，一直傳簡訊要討回去，她在請教大哥後，於協調會當天將包了2萬元的白包交給大姊，大姊也當面清點後收下，絕無侮辱大姊之意。
