延退休年限未獲勞工同意　台中商銀判付129萬

台中商業銀行林姓專員任職22年餘，前年6月她以任職20年申請退休，但是公司以1999年間，員工工作規則已變更為任職25年才能申請退休，故僅讓林女離職，林女不滿提告。

台中地院指台中商銀變更退休申請條件時，林女只剩7年7月即可退休，公司對於工作規則有不利益變更時，須勞資雙方同意，除非其變更具有合理性及必要性，故判決台中商銀要給付林女退休金共129萬餘元。
