酒測太嚴　翁無法單腳站30秒被移送

70幾歲的林老先生在警局單腳站了不到6秒就撐不住，雖然酒測值未達酒駕標準，但還是被警方移送法辦。

日前老先生騎車前喝了藥酒，騎機車時與人發生擦撞，警方進行酒測，老翁酒測值0.19，雖然躲過酒駕罰鍰，但警方還是對老翁進行生理平衡檢測，由於老翁無法單腳站立30秒，走直線腳步也不穩，並且語無倫次，警方認定他不能安全駕駛，依公共危險罪嫌送辦，然而宜蘭地檢署最後判定不起訴。

林姓老翁：「也不能說他們(警方)太超過，他們要怎樣我都沒關係，現在沒有起訴，內心有比較好受。」

宜蘭地檢署認為，要求70幾歲的老先生金雞獨立30秒，本身就有困難，再加上警方在認定老翁是否語無倫次也過於主觀。宜蘭地檢署主任林宏松：「即便他酒測值沒過，也不能當作唯一的依據，同樣的生理平衡檢測沒過，也不能因此認定他不能安全駕駛。」

檢方也表示，這次即使是年輕人也不會起訴，警方應該要以酒測值為準，不能光憑生理平衡檢測來評斷民眾能否安全駕駛，近年來警方取締酒駕越來越嚴格，民眾上路前還是避免喝含酒精飲品，避免造成不必要的困擾。
